  • The Company recognizes the importance of safeguarding consumer rights and enforcing user accountability;

NOW THEREFORE, Lust.Layer hereby adopts these Terms and Conditions to provide a lawful, equitable, and trustworthy digital experience for its Users.


1. DEFINITIONS AND INTERPRETATION

1.1. Definitions:

  • “Act” shall mean applicable Indian laws governing e-commerce operations including the Indian Contract Act, 1872; Consumer Protection Act, 2019; IT Act, 2000; and DPDP Act, 2023.
  • “User” or “Customer” shall mean any individual or legal entity who accesses the Website, creates an account, or places an order.

3. ELIGIBILITY TO CONTRACT

  • Non-Transferable: Accounts are personal and cannot be transferred.
  • Inactivity: Accounts inactive for 24 months may be deactivated with 30 days' notice.

7. PRICING, PAYMENT & SHIPPING CHARGES

  • Pricing: All prices are in Indian Rupees (INR) and inclusive of GST.
  • Payments: Accepted via secure, RBI-compliant third-party gateways. We do not store full card details.

8. ORDER CONFIRMATION & FULFILLMENT

  • Acknowledgement: Receipt of an email confirms the order was received, but not yet accepted.
  • Acceptance: An order is deemed accepted only upon internal verification and dispatch (Shipping Confirmation).
  • Dispatch Time: Estimated 1 to 3 business days post-verification.


9. ORDER CANCELLATION RIGHTS

15. INDEMNITY

The User agrees to indemnify and hold harmless Lust.Layer, its directors, and employees from claims, damages, or costs arising from the User’s breach of these Terms, violation of laws, or infringement of third-party rights.


16. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Lust.Layer shall not be liable for indirect or consequential damages (e.g., loss of profits). Total aggregate liability is limited to the value of the specific order paid by the User.


17. MISCELLANEOUS

  • Governing Law: Laws of India.
  • Jurisdiction: Exclusive jurisdiction of courts in GUNTUR, VIJAYAWADA, GURAZALA India.
  • Modifications: Lust.Layer reserves the right to modify these Terms at any time. Continued use implies acceptance.

ADDENDUM: LIMITED PERIOD SALE TERMS

(Applicable only during specific sale events marked on the Website)

  1. Scope: Discounts apply only to products expressly marked under the Sale.
  2. Stock: Limited availability; items may sell out during the transaction.
  3. No Returns on Sale: Sale items are Final Sale. No returns/exchanges allowed except for verified manufacturing defects.
  4. COD: Lust.Layer reserves the right to disable Cash on Delivery (COD) for sale orders.
  5. Prevalence: In case of conflict regarding sale items, these Sale Terms override the general Terms & Conditions.
